1. Scope and provider
These Terms of Service apply to downloading, opening and using the JustDrink mobile application and JustDrink Premium. JustDrink is offered by Per Programming in the Netherlands. Contact: apps@per-programming.com. Website: per-programming.com.
By using JustDrink, you agree to these Terms. If you do not agree, do not use the app. Mandatory consumer rights always remain applicable and take precedence over conflicting provisions in these Terms.
2. Age and responsible use
JustDrink contains references to alcohol and is intended only for persons aged 18 and over. The app never requires anyone to drink alcohol. Every player can skip a challenge, stop playing or use a non-alcoholic alternative.
You are responsible for safe and lawful use, your own health and limits, and respecting the limits of other players. Do not use JustDrink while driving, during dangerous activities, or when alcohol use is legally or medically inappropriate for you. JustDrink does not provide medical advice.
3. Licence to use
Per Programming grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use JustDrink for private purposes in accordance with these Terms and the rules of the applicable app store.
You may not sell, rent, copy, distribute, reverse engineer or circumvent the app, or use it to infringe the rights of others, except where expressly permitted by law.
4. Personal cards and locally stored data
You can store personal cards and player names on your device. You are responsible for this content and must not create or display unlawful, discriminatory, threatening or otherwise harmful content. Do not use personal data or material belonging to others without permission.
Personal cards, player names and sessions are stored locally. They may be lost if you uninstall the app, clear app data, change devices or experience a technical problem. Per Programming does not provide a cloud backup for this data and cannot recover it.
5. Availability and changes
We aim to keep JustDrink safe and usable but do not guarantee that the app will always be available without interruptions or errors. Maintenance, outages, changes by app stores or external services, and circumstances beyond our control may affect its operation.
We may change features, content and technical requirements to improve or secure the app, comply with the law, or keep it operational. Paid core functionality will not be materially reduced during an active subscription period without a valid reason. Where required, we will inform you in advance of significant adverse changes.
6. JustDrink Premium
JustDrink Premium unlocks the Premium features described in the app before purchase, including Premium categories and the ability to create and manage personal cards locally. The free parts of JustDrink remain usable without a subscription as indicated in the app.
You can choose a monthly or annual automatically renewing subscription. Google Play or the Apple App Store displays the current price, currency, billing period and any introductory terms before purchase. The app store charges the payment. The subscription renews automatically at the end of each period unless you cancel it through the applicable app store before the renewal date.
Price changes are announced through the app store and, where required, in advance. A price increase only takes effect in accordance with the app store rules and applicable law. If consent is required and you do not consent, the subscription may end at the end of the current period.
7. Cancellation, refunds and withdrawal rights
You manage and cancel your subscription through the subscription settings of Google Play or the Apple App Store. After cancellation, you normally retain access until the end of the paid period and will not be charged again. Uninstalling the app does not cancel a subscription.
Payments, refund requests and statutory withdrawal rights are handled under the rules of the app store where you purchased and applicable law. Nothing in these Terms limits any mandatory rights to a refund, remedy or termination that you have under applicable law.
8. External services and app stores
JustDrink uses services including Supabase for published card content, RevenueCat to verify Premium and, only after your consent, PostHog for product analytics and technical error information. The processing of personal data is described in the Privacy Policy.
Google Play and the Apple App Store have their own terms that may also apply to downloads and purchases. Their terms and procedures may apply to disputes concerning payment, billing or an app store account.
9. Intellectual property
JustDrink, its design, software, branding and the cards and texts provided by Per Programming are owned by Per Programming or its licensors and are protected by intellectual property rights. You retain any rights you have in your own personal cards, and you do not grant Per Programming access to or a licence for personal cards stored locally.
10. Liability
You use JustDrink at your own responsibility. Per Programming is not responsible for player choices, alcohol consumption, peer pressure or harm caused by disregarding instructions, health advice, legal age limits or personal boundaries.
To the extent permitted by law, Per Programming is not liable for indirect or consequential loss, loss of data or loss caused by temporary unavailability. This limitation does not apply to intent or deliberate recklessness by Per Programming, death or personal injury where liability cannot legally be excluded, or where mandatory consumer law provides otherwise.
11. Suspension and termination
We may restrict access to the app or certain features where necessary for security, legal compliance, preventing abuse or discontinuing a service. For an active paid subscription, we will take account of your statutory rights and the refund rules of the app store.
You may stop using and uninstall the app at any time. You must separately cancel a Premium subscription through the app store.
12. Changes to these Terms
We may update these Terms when the app, subscriptions, law or our services change. The latest version and effective date are available on this page. Where legally required, we will notify you in advance of material changes that adversely affect an active subscription.
13. Governing law and disputes
These Terms are governed by Dutch law. If you are a consumer who normally lives in another country, you retain the mandatory consumer protections of that country. Disputes may be submitted to the competent court under the applicable legal rules.
